Dear Friends,
My PD (EB3)is Dec-02. I have gone for Finger Printing twice now.
I see lot of reference to '45 Day letter' in the forum . I have no recollection of receiving the '45 Day ' letter so far.
Am I missing something here?
Can any one of you please explain what this letter is about?

When the state workforce agencies (DOL's) transfered their applications to the Backlog Reduction Centers (BEC), the BEC sent a 45 days letter to the petitioner and the attorney to confirm if they are still interested in proceeding with the pending labor (some were pending for 4-5 years and they do not want to work on it unless the petitioner is still interested). The BEC gives them 45 days to respond, hence the name.

labor is indeed more than 1 year old. Are you completely sure about this rule since having an approved 140 gives you a 3 year extemsion

Hi All,
I am attending my visa interview next week in one of the Indian consulate. Sometime back I came across a website which lists each persons interview date and there visa status - approved/denied. I am not able to re-collect that link
Does any one has any idea?. Basically that link shows the status of visa interviews conducted.

Hi,
I am on Adv-Parole (with EAD) and planning to visit India in July 2010.
I know that UK and France require transit visa, but I was wondering whether I can fly via KLM (Amsterdam) OR Lufthansa (Frankfurt) without any transit visa ?
Will appreciate the response.

I can say with certainity that transit visa is not required for return through Amsterdam on AP. This year 2010, was my second travel through Amsterdam with AP and the port officials really respected the document and treated me very well.

It should not. Go to the any INS office after you arrange for an appointment on line and ask tehm to replace your I-94 and to write the correct name.
Your case has been approved and tehre is nothing to do other than the above. My son been thru teh same process and when he applied for the visa abroad nobody asked him him at all about the error.

But I noticed that the attorney has done a typo in my middle name. she added 1 extra letter in the middle. can anyone please let me know if this would create any problem for me getting the H1B transfer approval and what is the way to correct it? Since I have already left my old job, I am kind of worried. Please reply back if anyone has come accross or aware of such case.

Your friend will only have problem if he tries to go directly from India to any Middle East, African, Eastern European , East Asian or Australia/NZ.
They will not allow your friend to board the plane from India without clearence from Labor Ministry in India.
It is mainly done so ppl arent exploited. Like taking young girls to Middle East where they may be abused.

Hi friends,
Since the h1b quota for year 2009 is not exhausted, can one(company) file the h1b visa right away or do we need to wait for April 2010?
One of my friends is interested in coming to the US. The consulting company to whom he applied said that they could only apply for the H1B visa in April 2010.

I have a question regarding changing L1 to H1-B visa. If someone comes to US on an L1 visa can he/she change to H1-B visa without going back to India and getting the new H1-B visa stamped? What is the process to remain in the US and changing the status from L1 to H1? Will

Yes, you can do a change of status (COS) from L1 to H1 without going back to India for Visa stamping. Your H1 will come under the annual 65,000 H1 cap, as you might know the cap of this year is already over, you can apply for this COS come April 1 2008 and you can start working October 1 2008 with your H1. Please note you CANNOT start working for a new employer by just receiving a receipt number for your COS. You will need to get the actual H1-B approval notice. While applying for the COS you will also need to show you are currently employed and this can be done by submitting two most recent pay checks along with your other papers. Hope this helps!!

Since your Father in law is a Central Govt Employee, i believe the reason they issued a white 221g is because he may not have provided a NOC (No objection Certificate) from the govt which should state that he is just travelling to US for tourism purposes and not for job related travel. This was how i had to get my father in law to get a NOC inorder to get his stamping done. Once they saw the NOC, they granted the visa.
My 2 cents.
He had the NOC with him and he did mention it to the Visa Officer about the NOC and she mentioned its not required and asked him to email his CV to the email address listed in the white slip for further processing.

Your new company must sponsor your H1 before the old company send the request to cancel your H1.

I am getting married in December 2007.
1. I am goin to file for my spouse at that time. Is it necessary that the dates should be current in order to file this amendement?
2. I understand that one can file amendment before or within 180 days of acceptance of 485. is this correct ?
3. Is there anyway to know that I am nearing my acceptance of 485?

485 receipt notice is required for new EAD or for renewal of existing EAD. Pl send them a copy of the I485 receipt notice document in addition to a copy of the existing EAD card
