You will have to staple the old passport to the newer one and carry both of them at all times. The visas on the previous passport will not be transferred over to the new passport.

I am asking this question for relative of mine. I wanted to get some honest opinions.
My relative was manager in India for family company (extended family) for 3-4 years. He received visitor visa about 2 years ago, and subsequently arrived in US.
After taking extended tour of US, he felt that he could expand Indian company's business in US. His companied in India tried to open up business in US. He received L1A for 1 year. However, due to bad economy, business advantature wasn't successful.
He wanted to try to stay in US and try some other management position for established company. Subsequently applied for H1B. He recently received denial notice from USCIS.
Currently, original L1A is expired. L1A extension is pending (lawyer was late in filing, and only filed 7 days before expiration of original L1A).
Is he out of status at this point (expired L1A and denied H1B)? L1A extension is still pending.
What are his option if he wants to stay LEGALLY in US?
Please excuse my ignorance but I do not know much about immigrations, as I am US Citizen myself and never had to go through this grusome process.
I would also appreciate attorney's input.

If they do approve your I485, you still have 180 days to file your dependants. It is called "Follow to join". Do a google search on "Follow to join greencard for spouse".

Iam on L2 and working on my EAD which is expiring on april 29 th 2011.
I have applied for H1 in the 2010 quota but due to my employers mistake i got a rejection on that.
we are trying to reappeal to USCIS but iam not sure if its going to work.
Suppose i have a project and apply again for 2011 quota , can i still continue working even if my EAD expires.
They say that we actually move to H1 on October , so if i apply before end of April through premium processing and get an approval notice before October can i continue working or start work right away or do i have to wait till October.
Is there a possibility to start working immediately as soon as my H1 gets approved or do we have to wait until October in any case.
Thanks in advance

Hello ,
We both husband and wife are on H1 B's and working and her six years will be completed 2 yrs from today.
My wife does not plan to start her GC with her employer and now I want to include her when filing I-485.
Do I have to fill out a seperate I-485 form for her ?
Do I have to fill out a seperate I-765 form for her ?
Do I have to fill out a seperate I-131 form for her?
Do I have to fill out a seperate G-325 form for her ?
Do I have to file the support affidavit(I-864) for her ?
Please do take time to answer .
Thanks
you have to fill separate forms for yourself and your wife
in your wife's application , a copy of approved I140 or pending receipt must be included and also the I -864
Marriage certificate should be in both the applications.

Interesting- Never done a FOIA request for just an approval.
I might try filing an I-824 seeking a duplicate approval notice.

OK. I give you the benefit of doubt. I gave 10 detailed replies on this subject.
but a search for 'skin test' gave me:
Search: Key Word(s): "skin, test" ; Forum: All other Green Card Issues and child forums
Showing results 1 to 6 of 6
Search took 0.03 seconds.
Doctor will keep x-ray. and write a report that there is no evidence of any active contagious TB infection now or in the past. Something like that. he will enclose it in the sealed cover.
Plus
advice to county to start INH regimen.
or
nothing. Go home nicely. As in my case.

Pappu, very good article. I saw this in this month's Kiplinger.
A penny saved is 'far better than' a penny earned because you don't have to pay taxes for the penny you saved whereas you have to pay taxes for the one you earned!

Good day everyone,
I am currently on H1B (company A) and am waiting for my new employer (company B) to do the transfer of my H1B. The stupid thing that I did was I gave my two weeks notice already (I have about 10 more business days left). My questions are:
1. How would the USCIS knows my last day of employment in company A? Do they know this only if employer A terminates my H1B?
2. What if I ask employer A not to terminate my H1B, at least until the actual filing (by company B) occurs?
Please advise, suggest and/or comment.
Thank you in advance,
T

I think this office has more folks...
anyways, I do not know for sure.
Last time I called I was on the phone for 2 hours waiting and talking to them for 45 minutes or so them trying to figure out what is wrong...they could not and was promised that I would hear back from them in a day...well its a week since then and no news...
yesterday when I created this post I was in q waiting to talk to someone...
waited for 3 hours and when I finally reached number 1 in q it was another 30 to 45 minutes wait (as #1 in q) but I guess they had already packed up for the day as I had called at 4 pm and reached #1 at 6:30 PM and at 7:15 PM they happily disconnected the call from q.... (which is not a suprise or is not the first time they did this)
I also wonder under what basis our nice consulate stopped taking PIO and OCI application for a month (in Feb-Mar time frame) and now they are either heavily backlogged (as we are nearing the vacation season) or just that Travisa has no clue of thier act
Travisa is horrible !!

Employer can revoke 140 but as 180 days have passed you will have to demonstrate to USCIS that your 140 would have been approved with the new company if it was filed. That is somewhat not very straightforward so my suggestion is that you should take your employer in confidence so that 140 is not revoked......
AC21 - Job title can be different but job duties have to be similar. Similar duties are a MUST to avoid any issues with AOS.......also you dont have to inform USCIS that you changed your employer........there are pros and cons of it but what I have seen is that most people do not infrom USCIS......when USCIS comes to a point that they will adjust your status they might check with you if you are working with same employer and issue a RFE which you can respond to easily with the help of an attorney (just hv to make sure that job duties are similar and the new employer will issue you a letter which will prove it)
Make sure that you talk to HR and your manager if you take up a new job to acertain that job duties match, run both job descriptions by your attorney......better to take precaution than to be sorry.

Dear IV Members,
Plans for Next Call
As I draft this post, we are working on the specifics of organizing the next call. We intend to have the call next friday, 20 Oct 2006, and are awaiting confirmation. Please watch out for more information on the forums in the next couple of days.
Range of questions for the upcoming call
At this time, the list of questions has been frozen for the next call. The range of accepted questions is between 71 and 100. This post is being communicated so that members can plan to be present for any follow-up questions they may request the attorney in real-time
Questions not accepted by the attorney
Questions with the following IDs were not accepted by the attorney for the upcoming call: 87, 91, 95, 99
Why was my question not taken up?
The following is a list of probable reasons why certain questions may not have been accepted. This list, is of course, not exhaustive.
- too complicated for a call requiring further discussion or research
- lack of clarity in the law on specific situations
- incomplete
- too generic
- frivioulous
- no previous incidence that the attorney can draw upon without significant research(new situation)
Sending us your questions
We also request members to not send emails from corporate email accounts. It is IV's policy to refrain as much as possible from sending email to members that may constitute as spam.
While we do not want to spam you, there might be exceptional situations wherein we may need to alert you of last-minute changes, and corporate email accounts might consider such alerts(if at all, any) as spam and may hence be filtered.
Keep 'em coming
Lastly, do not let a rejected question deter you from sending in new questions. We encourage you to keep sending in your questions so that we can leverage the attorney's pro bono service.
Enhancing and streamlining the conf. call process
We realize that certain questions may be time-sensitive, and may no longer be relevant when we finalize on a conference call date. Please bear with us as we streamline the process and make our response times better.
Thank you
